Digital Millennium Copyright Act Compliance, Takedown Procedures & Counter-Notice Rights

1. Overview & Legal Basis

3. How to Submit a DMCA Takedown Notice

5. Counter-Notice Procedure

If content you uploaded or shared was removed or disabled as a result of a DMCA takedown notice, and you believe the removal was made in error or as a result of misidentification, you have the right to submit a counter-notice under 17 U.S.C. § 512(g).

A counter-notice must include:

  • Your full legal name, mailing address, telephone number, and email address
  • Identification of the material that was removed and the location at which it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification

6. Repeat Infringer Policy

Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake, may be held liable for damages, including costs and attorneys’ fees incurred by MB WhatsApp or the affected user.

MB WhatsApp strongly advises all parties to consult qualified legal counsel before submitting a DMCA notice or counter-notice if there is any uncertainty about the validity of their claim.

Abuse of the DMCA process including using takedown notices to suppress legitimate speech, competition, or criticism — is both legally and ethically prohibited. MB WhatsApp will not process notices that appear to be submitted in bad faith.

8. Fair Use Consideration
